GENERAL TERMS AND CONDITIONS – THERMOFLOC.BE

1. Scope of application

1.1. These general terms and conditions apply to all quotes, orders, deliveries, and agreements betweenThermoFloc Belgium – Beekvelden 9A, 2520 Ranst – BE 0845.511.782and the customer.

1.2. By placing an order, the customer accepts these terms and conditions without reservation.

1.3. Deviations are only valid after written agreement from ThermoFloc Belgium.

2. Quotes and orders

2.1. Quotes are valid for30 days, unless otherwise stated.

2.2. An agreement is established after written order confirmation or after execution of the order.

2.3. Obvious mistakes or errors in prices do not bind ThermoFloc Belgium.

3. Prices

3.1. Prices are expressed in euros, excluding VAT and transport costs unless otherwise stated.

3.2. Additional costs (delivery with crane, waiting times, special access) will be charged separately.

3.3. In the event of an increase in raw material or transport prices, ThermoFloc Belgium may adjust the price up to delivery.

4. Delivery

4.1. Delivery times areindicativeand do not entitle to compensation in case of delay.

4.2. The goods are deemed to be delivered upon arrival at the address specified by the customer.

4.3. The risk transfers to the customer upon delivery, even when transport is organized by ThermoFloc.

5. Visible defects and complaints

5.1. Visible damage or shortages mustbe reported immediately upon deliveryon the delivery note.

5.2. Hidden defects must be reported in writing within8 daysof discovery.

5.3. Complaints do not suspend the payment obligation.

6. Right of withdrawal (B2C only)

6.1. Consumers have the right to withdraw their online purchase within14 days after delivery..

6.2. Returns are only possible forunopened, undamaged, and original packagingof insulation material.

6.3. The costs of return shipping are borne by the consumer.

6.4. Professional customers (B2B) do not have a statutory right of withdrawal.

7. Retention of title

7.1. All goods remain the property of ThermoFloc Belgium until full payment of the invoice, costs, and interest.

7.2. The customer may not dispose of or process the goods as long as they have not been paid for.

8. Payment

8.1. Invoices are payablein cash or within the specified term..

8.2. In case of non-payment on the due date, the following is automatically due:

  • a late payment interest of 12% per year

  • a flat-rate compensation of 10% with a minimum of €150.

8.3. Non-payment of one invoice makes all other invoices immediately due.

9. Liability

9.1. ThermoFloc Belgium is only liable for direct damage.

9.2. Liability is always limited to the invoice value of the delivered goods.

9.3. ThermoFloc is not liable for:

  • incorrect placement by the customer

  • incorrect calculations of quantities

  • normal product characteristics of cellulose.

10. Cancellation

10.1. In case of cancellation of an order, a fee may be charged of40% of the order valueto cover administration and reservation of goods.

11. Force Majeure

11.1. Force majeure (scarcity, strikes, transport problems, production problems) gives ThermoFloc the right to suspend or cancel delivery without compensation.

12. Data and Privacy

12.1. Personal data is processed in accordance with the privacy policy of Thermofloc.be and the GDPR.

13. Applicable Law and Jurisdiction

13.1. OnlyBelgian lawis applicable.

13.2. Only the courts ofAntwerp.
